Now Donal trump is the first former U .S president to face criminal Charges after a Newyork grand jury voted to induct him Thursday.
While the charges have not been made public,the grand jury had been investigating hush money payments to two women who claimed to have had sex with the former president, including adult film star stormy Daniels ,those details made public only after he was elected as president in 2016.
On Tuesday trump is expected to be arraigned in a Manhattan criminal court
What is arraignment:
An arraignment is when formal charges against the accused are read by judge.This proceedding is the first time the accused appears before a judge and is told about the specific charges they are facing.
What happens at an arraignment:
The judge identifies the defendant by name and reads the official charges at an arraignment.The accused is asked how they want to plead and are told about their right to be represented by a lawyer.
After that the judge will then decide if bail is required for the defendant to be realised.the judge can decide to set no bail ,in that scenario the defendant is immediately realised without being placed in jail.
What does plea mean ?
A plea is the defendant”s formal response to the charges made by someone in a criminal case.
If someone pleads “guilty”they are admitting to committing the crime they were charged with.Depending on the crime ,they may go to jail if pleading guilty.
If someone pleads “not guilty” they are denying the accused crimes ,in that case the defendant will go on trial while the prosecution will work to prove their involvement “beyond a reasonable doubt every part of the offence
Difference between indictment, arraignment and arrest :
A firmal charge of crime is indictment.it is a decision by grand jury that prosecutors can continue with a case against the defendant .it is not a conviction.
An arrest is when a person is taken into custody.An arraignment is when formal charges against the accused are read by the judge fir the first time.
